Customer: hereby named 'you'
PROCESS:
Motion gimmick - MediaArt sends to you the ordered
software through Electronic Mail (Email) in return for
payment. The online payment systems handles the
transaction process. It allows credit card payment in an
absolutely secure way. Information about paying money with
PayPal.It can be found on the PayPal Website (www.paypal.com.)
The given information will be sent to Motion gimmick -
MediaArt through the PayPal notification system and you
also receives a notification email from PayPal including
all transaction and payment details.
REVOCATION:
For it is electronically sent software, a right of
revocation or return of the plugin and thus a refund of
the payment after receiving the software does not exist.
CUSTOMER DUTYS:
The Terms Of Use have to be read and understood by you
before buying any software from Motion gimmick -
MediaArt.
Should these information not be accessible
because of arbitrary reasons (server problems or
something comparable), you are obliged to contact Motion
gimmick - MediaArt via email or by phone and ask for
permission to see the Terms Of Use. If the consumer does not
do this, he agrees that he has read and understood the information
listed here in the Terms Of Use.
CONTRACT:
The contract between the you and Motion gimmick -
MediaArt becomes valid with the payment and order.
Orders and payments that are not received by Motion gimmick -
MediaArt (may it be a mail server problem or an issue of
PayPal) are no valid orders.
SECURITY AND DATA STORAGE:
Any data related to the process of purchasing any
software of Motion gimmick - MediaArt will be stored
electronically and in printed version by Motion gimmick -
MediaArt. Motion gimmick - MediaArt guarantees that all
information are handled secretly to the best of Motion
gimmick - MediaArt s knowledge. Motion gimmick - MediaArt
will not give out any information to anyone or to any third person
without your prior and written agreement.
CONTRACT DURATION:
The accrued contract will remain intact until you receive
an Email from Motion gimmick - MediaArt including the
software in attachment after payment.
PURCHASING COSTS:
There will only be your usual PayPal costs/fees. This
depends on how your PayPal account looks like. There are
no other costs charged from Motion gimmick - MediaArt
than the software price itself when using PayPal. The
software price includes the local german tax.
SHIPMENT DURATION:
Shipment of any software may take up to five business days. Otherwise please contact info@motion-gimmick.com
GERMANY ONLY - Überweisungszahlungen:
Bestellung von Software via deutschem Banktransfer
(Überweisung) obliegt den gleichen, in diesen AGBs
aufgeführten, Regeln. Der Vertrag kommt mit der
Bestellung zustande. Der Vertrag endet mit der
ordnungsgemäßen Einzahlung der Gesamtsumme für die
bestellten Produkte (Software) durch den Kunden (im oberen Teil you genannt), sowie dem Versand der Software per
Email und der Registrierungsinformationen.Diese
Zahlungsmethode gilt nur innerhalb Deutschlands.
Widerrufsbelehrung
Gemäß § 312 c Abs. 1 Bürgerliches Gesetzbuch
(BGB) sind wir verpflichtet auf folgendes hinzuweisen:
Besondere Hinweise
Das Widerrufsrecht gilt nur für Verträge die mit
Verbrauchern geschlossen werden und keine Leistungen bzw.
Waren beinhalten, die eigens für Sie hergestellt werden
oder auf ihre persönlichen Bedürfnisse zugeschnitten sind
oder aufgrund ihrer Beschaffenheit nicht für eine
Rücksendung geeignet sind, wie im vorliegenden Falle des
Pluginversandes per Email.
Hieraus ergibt sich, daß
das Widerrufsrecht vorzeitig erlischt , wenn motion
gimmick - MediaArt mit der Ausführung der Dienstleistung
mit Ihrer ausdrücklichen Zustimmung vor Ende der Widerrufsfrist
begonnen hat oder Sie diese selbst veranlasst haben z. B. durch
Download von Softwareprogrammen, Online-Aufträge im Rahmen
der Echtzeitbestellung, Lieferung von Plugins per Email.
Datenschutz
Personenbezogene Daten
des Kunden (z. B. Anrede, Name, Anschrift,
E-Mail-Adresse etc. werden nur erhoben, verarbeitet und genutzt,
soweit dies zur Vertragsabwicklung (Bestandsdaten),
Leistungserbringung oder Abrechnung (Nutzungsdaten)
erforderlich ist.
Änderungsvorbehalt
motion gimmick - MediaArt ist berechtigt, die AGB und die Preise
für die Zukunft zu ändern oder zu ergänzen. Der Kunde
ist verpflichtet, die AGB in regelmäßigen Zeitabständen
auf Änderungen oder Ergänzungen zu prüfen. Der Kunde
erklärt sich mit jeder Nutzung mit der jeweils gültigen
Fassung der AGB einverstanden.
Ersetzung, anzuwendendes Recht, Gerichtsstand
Sollten einzelne Bestimmungen ganz oder teilweise
unwirksam sein, berührt dies die Wirksamkeit der übrigen
Bestimmungen nicht. Die Parteien verpflichten sich, die
Bestimmung durch eine wirksame Bestimmung zu ersetzen,
die dem wirtschaftlichen Zweck der ungültigen Bestimmung
möglichst nahe kommt. Entsprechendes gilt für etwaige
Regelungslücken. Es gilt das Recht der Bundesrepublik
Deutschland unter Ausschluß des Internationalen
Kaufrechts. Für Kaufleute ist ausschließlicher Gerichtsstand
Osnabrück.
Gemäß § 19 UStG enthält der ausgewiesene Betrag keine Umsatzsteuer
